I. General Rules

  1. The training and sim racing center is an integral part of the Apex One facility210 South Avenue W. Westfield, NJ 07090 U.S.A
  2. The center operates according to a schedule, which may be subject to change without prior notice to customers. Working hours on holidays and non-working days are determined individually and published at least one day in advance on the homepage at www.nj.westfield.apexone.eu and the center’s social media page.

  3. Anyone entering Apex One’s premises and using its services is required to familiarize themselves with these Terms and Conditions prior to entering. Entering the premises constitutes acceptance of these Terms and Conditions.
  4. Individuals wishing to use the services provided at the facility must pay for these services in accordance with the current price list.
  5. Every user of the center is required to undergo mandatory training on using the equipment before starting a simulation. In case of any doubts, questions, or safety issues, the person using the simulator must immediately stop the game and call for assistance.
  6. Users of the center are responsible for ensuring that all individuals using the booked services alongside them comply with these Terms and Conditions.
  7. Individuals disrupting public order, behaving indecently, using profanity, violating these Terms and Conditions, or disregarding the staff’s instructions may be immediately removed from the premises, with the obligation to pay for all provided services. If simulators were reserved for a specific time, payment is also required for the reserved simulators.

II. Safety and Responsibility

  1. Users are responsible for their own safety and for the proper use of the equipment and facilities.
  2. The staff of Apex One reserves the right to deny service to individuals under the influence of alcohol, drugs, or other substances that may impair judgment or behavior.
  3. Children under the age of 16 must be accompanied by a parent or guardian at all times.
  4. Users are prohibited from bringing food, drinks, or sharp objects into the simulator area.
  5. Any damages to the equipment or facilities caused by a user’s negligence will result in the user bearing the repair or replacement costs.

III. Booking and Payments

  1. Booking a simulator or other services can be made in person, by phone, or online via the website.
  2. Payment must be made in advance, either at the time of booking or upon arrival at the center.
  3. Cancellations or changes to bookings must be made at least 24 hours before the scheduled time. Failure to do so will result in forfeiture of the payment.
  4. Refunds are not available for services that have already been used.
  5. Gift cards and vouchers are valid for 12 months from the date of purchase, unless otherwise specified.

IV. Data Protection

  1. By using Apex One’s services, users consent to the processing of their personal data for the purposes of booking, payment, and service provision in accordance with applicable data protection laws.
  2. Apex One may use surveillance systems for safety and security purposes. Recorded footage will be handled in compliance with data protection regulations.
  3. Users have the right to access, correct, or request the deletion of their personal data by contacting the center.

V. Complaints

  1. Complaints regarding services provided by Apex One should be submitted in writing to the facility’s address or via email to the contact address provided on the website.
  2. Complaints will be addressed within 14 business days of receipt.

VI. Final Provisions

  1. Apex One reserves the right to modify these Terms and Conditions at any time. Changes will be published on the website and take effect upon publication.
  2. Any disputes arising from the use of the center’s services will be resolved amicably, and if this is not possible, they will be subject to the jurisdiction of Polish courts.
